TERMS AND CONDITIONS

For The Use of ST HUB of ST Bank Limited

-          Pursuant to the Law on Commercial Bank No. 56/NA, dated 07 December 2018;

-          Pursuant to the Law on Payment System No. 32/NA, dated 07 November 2017.

ST HUB is one of the products developed and launched by ST Bank Limited (“STB”) with an aim at easing customer’s transactions such as: fund transfer, payment transaction, checking account balance and STB card transaction through electronic devices namely smart phones, tablets and other electronic devices compatible with ST HUB. The User agrees to be bound by and comply with the following terms and conditions:

1.                Definitions

a)           STB” refers to ST Bank Limited, its branches, service units and employees;

b)           User” refers to a customer who opens a bank account with STB and register for ST HUB;

c)           User’s Bank Account” refers to the User’s bank account opened with STB including ATM, virtual card and other electronic cards issued by STB to the User which was used to register for ST HUB;

d)           Business Partners” refer to companies or organizations that STB entered into agreements with in order to allow the User to conduct various payment transactions through ST HUB;

e)           Personal Identification Number (PIN)” refers to the User’s passcode registered with STB and used to access ST HUB;

f)            ST HUB Transactions” refer to fund transfer and payment transactions processed through ST HUB;

g)           Transaction Order” refer to an order instructed by the User to STB through ST HUB in order to conduct fund transfer or payment transactions;

h)           Service Policies” refer to internal policies of STB promulgated and amended in accordance with the laws and regulations periodically issued by the Bank of the Lao PDR which can be announced and applied with immediate effect.

2.                Terms for the Use of ST HUB

2.1              The User must be 18 years of age or over;

2.2              The User hereby agrees that STB may deduct fund in the User’s Bank Account in accordance with the User’s Transaction Order effected through ST HUB (such deduction includes amount per Transaction Order, bank fees and amount per exchange rate).

2.3              The User agrees and accepts to pay STB fees and service charges related to the transaction processed through ST HUB and for other services of STB and agrees that STB may deduct fund in the User’s Bank Account for such fees and service charges.

2.4              The User agrees and accepts that STB may amend any term and condition including its fees and service charges without giving any prior notice to the User.

3.                Data Collection and Confidentiality

3.1              The User agrees that STB can collect information used for registration in ST HUB and other information, including personal and confidential information, of the User for the purpose of using various services of STB and for developing ST HUB and other services of STB.

3.2              STB undertakes to protect and keep all information collected from the User strictly confidential and shall not disclose such information to any other unrelated person and/or a third party unless a written consent is received from the User.

3.3              Notwithstanding the clause 3.2, the User agrees and accepts that STB may partly or wholly disclose the information collected from the User to its Business Partners for the purpose of processing the ST HUB Transaction or to comply with an order of a competent court or government authority.

4.                PIN and Obligation to Notify STB

4.1              The User shall not use PIN which is too short or easy to guess and shall keep his/her PIN strictly confidential and shall not disclose or allow other persons to use it.

4.2              The User may change his/her ST HUB PIN at any time by complying with the methods and conditions issued by STB.

4.3              In case that the User suspects that other persons would know his/her PIN or in case that the device used to access ST HUB has been hacked or lost, the User is obliged to notify and request STB for suspension of the PIN and STB will process such suspension once the User complies with the terms of STB and STB is able to verify that the requestor is the User who owns the PIN. In case such suspension causes any interruption, damages or loss to any or all of the User’s ST HUB Transactions, the User agrees to be solely liable for that.

·         In addition, the User may contact STB directly via service counter at the head office, branches, and service units of STB during working hours.

5.                Disclaimer

STB shall not be liable for any fund, loss or damage occurred with the User’s ST HUB Transactions, the User’s Bank Account or other persons in any of the following cases:

§  Any completed transaction duly effected in accordance with regulations, Service Policies of STB, agreements or undertakings between STB and the User or any transaction duly processed in accordance with the Transaction Order or instruction of the User;

§  The User conducts the ST HUB Transaction by inserting inaccurate information such as: fund transfer with wrong amount or to wrong account, making payment transaction with inaccurate amount but such transaction is completed;

§  The User gives his/her PIN to others to access ST HUB and/or to conduct the ST HUB Transaction;

§  The User has intentional or negligent act causing the device used to access ST HUB to be hacked or allow other persons to know the User’s PIN and access ST HUB to conduct transactions;

§  The User received notice from STB that ST HUB is experiencing temporary interruption but the User continues to use or conduct ST HUB Transaction which results in damage or loss;

§  STB refuses to process the Transaction Order instructed by the User on any of the following reasons:

-         The User has insufficient fund to process the transaction or the Transaction Order is in excess of the maximum line limit periodically stipulated by STB;

-         The User fails to comply with any term and condition, regulation or agreement and undertaking with STB;

-         There is a decision or order from a competent government authority or court with jurisdiction which orders STB to suspend any transaction or service to be rendered as per the User’s instruction;

-         STB already inform the User that ST HUB is experiencing interruption for the ST HUB Transaction before or during the time the User is making the Transaction Order.

§  Losses or damages occurred from the payment system of Business Partners without any defect or default from STB or ST HUB;

§  There is a Force Majeure event that prevents STB from processing the User’s Transaction Order.

§  STB already notifies the User regarding the addition or removal of products in ST HUB through all STB official advertising channels, contact between STB and the User and/or through the specific channel which is easily accessible by the User.

6.                Force Majeure

Force Majeurerefers to any of the following events or circumstances that prevent STB from providing services to the User in accordance with these Terms and Conditions. Such Force Majeure includes the prohibitions or acts of the government or government authorities, failure or malfunction of computer, communication, internet or banking system due to power supply or disruption of power system or any event which causes such failure which is beyond control of STB, riot, war, public disorder, protest, labor dispute, strike, pandemic, fire, flood, earthquake, storm, natural disasters or other events beyond control of STB. In case any event of the Force Majeure occurs, STB shall not be liable for any loss or damage occurred with the User’s ST HUB Transaction, the User’s Bank Account or to other persons.

7.                Termination and Suspension of ST HUB Service

7.1              STB has the right to terminate or suspend the provision of ST HUB service to any User at any time in the event that the User fails to comply with these Terms and Conditions, regulations of STB and the laws of the Lao PDR or in case there is a decision or order from a competent government authority or court with jurisdiction which orders STB to suspend any transaction or service to be rendered in accordance with the User’s instruction.

7.2              In case that the User would like to terminate the use of ST HUB service, the User must come to the service counter of STB and fill in the form to terminate the use of ST HUB service in accordance with the form and regulation issued periodically by STB and the User must pay all the outstanding fees and service charges (if any) to STB.

8.                Dispute Resolution

In case of dispute, STB and the User shall resolve the dispute through amicable negotiation within 15 calendar days. If such dispute cannot be resolved through such negotiation, it shall be referred to a competent people’s court of the Lao PDR to resolve it in accordance with the laws of the Lao PDR.

9.                Governing Law

These Terms and Conditions shall be construed and governed under the laws of the Lao PDR.

10.           Implementation

By accepting these Terms and Conditions, the User agrees and accepts that the User have read, understood and agreed to be bound by these Terms and Conditions in all aspects.
